Acceptance of Terms
Welcome to Shallot. These Terms of Service ("Terms") govern your use of the Shallot recipe organizer app and related services (the "Service") operated by Scott Vehrenkamp ("we", "us", "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
Description of Service
Shallot is a recipe organizer app for iOS that enables users to:
- Save recipes from Instagram, TikTok, YouTube, Pinterest, and other websites
- Organize and categorize their recipe collections
- Access their saved recipes across their devices via iCloud sync
- Add personal notes and tags to recipes
- Search and filter their recipe library
The Service is provided via an iOS app and is intended for personal use in organizing and accessing recipes.
User Accounts
To use certain features of the Service, you may be required to create an account. When you create an account, you must:
- Be at least 13 years of age
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
You are responsible for safeguarding the password and all activities that happen under your account.
Acceptable Use
You may use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service:
Permitted Uses
- For personal, non-commercial recipe organization and storage
- To save and organize recipes from publicly available sources
- To add personal notes and organization to your recipe collection
Prohibited Uses
- To scrape, reverse engineer, or attempt to extract the source code of the app
- To redistribute, resell, or commercialize the app or its content
- To use the Service to collect data about other users
- To submit fake or fraudulent waitlist signups or account registrations
- To use automated tools, bots, or scripts to interact with the Service
- To violate any applicable local, state, national, or international law
- To transmit any harmful, threatening, or inappropriate content
- To interfere with or disrupt the Service or servers
Intellectual Property
Shallot's Property
The Shallot app, including its original content, features, functionality, design, and underlying software, is and will remain the exclusive property of Scott Vehrenkamp. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.
Recipe Content
Recipes you save through Shallot belong to their original creators. Shallot provides a bookmarking and organization service, not ownership or redistribution rights. We respect the intellectual property rights of recipe creators and expect users to do the same.
Your Data
You retain ownership of your personal data and recipe collections. We do not claim ownership of the recipes you save or the personal notes you add to them.
Content from Third Parties
Shallot imports recipe content from third-party platforms and websites. Please understand:
- We do not guarantee the accuracy, completeness, or availability of imported recipe content
- Recipe content may change or become unavailable if the original source is modified or removed
- We are not responsible for the content, accuracy, or availability of external websites or platforms
- You are responsible for verifying recipe information and ingredients for safety and dietary requirements
If original content is removed from its source, your saved copy in Shallot may become incomplete or outdated.
Subscription & Payment
Current Status:
Shallot is currently free during the pre-launch period. All features are available at no cost while we develop and refine the app.
Future Pricing
We may introduce paid features or subscription plans in the future. If we do:
- We will provide clear advance notice of any pricing changes
- Existing users will receive detailed information about new pricing models
- Any paid features will include clear pricing and cancellation options
- Core functionality will remain accessible to existing users
Subscription fees, if introduced, will be processed through the Apple App Store and subject to Apple's terms and refund policies.
Limitation of Liability
The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, in no event shall Scott Vehrenkamp be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, data, use, goodwill, or other intangible losses.
Our total liability to you for any damages arising from or related to these Terms or your use of the Service shall not exceed the amount you have paid us in the prior twelve (12) months, or one hundred dollars ($100), whichever is less.
We are not liable for any loss of recipes, data loss, service interruptions, or issues related to third-party content or platforms.
Termination
Your Rights
You may stop using the app and delete your account at any time. If you wish to permanently delete your account and data, please contact us for assistance with data export and deletion.
Our Rights
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:
- Violates these Terms or our policies
- Is harmful to other users, us, or third parties
- Violates applicable law
- Is fraudulent or involves unauthorized use
Data After Termination
Upon termination, we will make reasonable efforts to provide you with access to your account data for export. After a reasonable period, account data may be permanently deleted unless legally required to be retained.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will:
- Provide at least 30 days notice prior to any new terms taking effect
- Send email notification to registered users
- Display a prominent notice in the app
- Update the "Last Updated" date at the top of this page
Your continued use of the Service after any changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be interpreted and governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Texas.
